Clinical Negligence Solicitors

By Shannon L Smith

In the UK medical negligence solicitor is a leading profession among the lawyer fraternity. They are known for helping clients get compensation for medical negligence. They are experienced enough in dealing with the complex issues and disputes related to medical injuries. They are highly qualified and efficient in their field.

The legal term used to describe a medical accident is 'clinical negligence'. What it means is that the medical practitioner did not give the proper care or treatment to a patient. This does not imply that the person was incompetent; it just means that they made a mistake and did not do the correct diagnosis or prescribed the wrong treatment.

What clinical negligence means that the, diagnosis was wrong; the proper treatment was not given, a mistake was made during surgery. It can also include; not giving the correct treatment, not warning you of the risks involved, not getting your consent to the treatment.

When a client seeks help, the lawyer will listen to the person, take notes and ascertain if the client can file a claim for medical negligence. The task of a medical negligence solicitor is to provide his client justice through the court with his efficient work experience.

The whole case depends upon the extent of evidence provided by the client to the solicitor. The solicitor will consult a doctor to establish that medical negligence did occur. After gathering proof the solicitor will first talk to the doctor against whom the claim is to be filed. The doctor may decide to settle the matter out of court. The reason for this is that a doctor fears that if medical negligence is proved against him or her, they stand to lose their license to practice. In case the doctor refuses to pay compensation, the solicitor will file a claim on the client's behalf. Further, the solicitor will prepare the arguments on behalf of his client.

Another point to remember is that a medical negligence lawsuit can take quite a while to get resolved as arguments and counter arguments are made. In a number of cases the aggrieved party just wants admittance that the doctor was negligent. But most doctors are afraid to admit this and that's why so many cases of medical negligence are filed almost regularly.

However this number has declined as most medical practitioners have become very careful, as they stand to lose more than just money. They can lose their license and reputation as well. Medical negligence solicitors came into their own after a number of people sought out their services, and today there are quite a few of them in the UK.
